do I need to get a Lawyer? Or can I simply do it all myself legally??? Any advice would be greatly appreciated! :)How do you sell a home ';For Sale By Owner';???
1. Put an ad in the papers and plenty of signs.
2. Contact a real estate attorney and talk to them and they can answer all of your questions for free on the phone. Find a good one and have them prepare a good contract once you have a buyer. This is to protect you and the buyer from any problems or mishaps. This will cost approx. 150-300 but well worth it and can be taken out at closing.
3. The buyer gets to choose the attorney for the closing. If you have any questions about the closing documents then have the attorney who drew the contract up to review the documents.
The key here is to protect yourself and the buyers will also be protected. DO NOT make a verbal deal on anything that will only bite you on the but later. How do you sell a home ';For Sale By Owner';???

Good luck!
You should contact a real estate attorney so you know all the required disclosures that must be made for your state and you have a plan for preparing the contract if you procure a buyer.
You should also be prepared for your phone to ring off the hook with agents calling you offering to list your home.... and don't be so quick to brush them off.
Every year NAR (National Assn. of Realtors) commissions a home buyers and home sellers survey. The 2005 NAR data showed that homes sold by practitioners fetched 16 percent more than those sold by FSBOs. The 2006 data shows an even greater difference for those who start out with an agent
Also about 83% of sellers who start out FSBO end up listing eventually.
Here are the numbers from the 2006 survey
median income median selling price
Agent-assisted $87,100 $250,000
First FSBO,
then agent-assisted $70,700 $192,000
FSBO/don鈥檛
know buyers $77,800 $187,200
Good luck to you, I talk to FSBO's quite often, and not to pressure them, but just to be a resource. If you can find an agent out of the hundreds that call that is willing to do that, keep in contact with them. BEst of luck to you
legally you can sell your own home without any assistance. However, if you lack the knowledge to do so, you might want to use an agent to help you out on something that is so valuable. For example, I took shop class in high school and I have a basic understanding on how engines work, but I still take my car to the mechanic when I need it fixed.
Regards
I don't believe it is necessary to be represented by anyone in selling a home. The buyer usually retains either an attorney or a title company to do a real estate search. It is beneficial to have representation if you can afford it but I don't think it is required in most cases.
